LEGAL BASES FOR THE WEB BUNDLE GIVEAWAY
1.- COMPANY ORGANIZING THE PROMOTION
The company SAPRO TRADING, SL (hereinafter SIMUFY) with registered office at C/. Pas blau, s/n 08787 La Pobla de Claramunt, Barcelona (Spain) and identification number B67553040, organizes for promotional purposes the national raffle, to be developed through social networks, exclusively for users of legal age in accordance with the provisions set forth in the section on conditions for participation.
2.- START DATE AND END DATE
The promotion will start on 10/11/2022 and end on 28/11/2022 at 11:59 PM.
3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS
It is important to emphasize that participation in the promotion implies unconditional acceptance and compliance with the provisions of these Legal Bases.
The participation requirements will be as follows:
- Those who reside in Spain and are over 18 years of age are eligible to participate.
- Only real, individual participants are eligible to participate. Participation by a company or brand profile will never be considered valid.
The mechanics of the Promotion consist of:
- Placing an order for an amount greater than €100 on www.simufy.com between 10/11/22 and 28/11/2022 at 11:59 p.m.
- For every €100 spent on a purchase, the customer will be assigned one entry into the drawing (for example, for a €230 order, 2 entries would be assigned, and for a €980 order, 9 entries would be assigned).
- In the case of more than one order per customer, entries are cumulative, but the total order value is not. For clarification, a customer who places a first order of €120 and a second order of €290 will receive one entry for the first order and two entries for the second. Therefore, they will participate in the promotion with a total of three entries. Under no circumstances will the order value of €410 be combined, which erroneously assigns four entries.
4.- CONDITIONS OF THE PROMOTION AND PRIZES
One winner and five alternates will be drawn from the drawing on November 30, 2022.
The winners and alternates will be randomly selected through Easypromos. The certificate of validity will be publicly displayed on the Easypromos portal and may be requested by any user participating in the promotion. This certificate and the result of the promotion are unalterable.
The winner will receive a prize pack valued at 2,247.90 EUR , consisting of:
- 1 Life PRO model Cockpit from the NWS brand.
- 1 Set of pedals (Accelerator + brake) Forte model from the Asetek SimSports brand.
- 1 Base Direct Drive model R9 from the MOZA Racing brand.
- 1 GS model steering wheel from the MOZA Racing brand.
The winner must contact SIMUFY within 48 hours of the winner's name being announced on the brand's official social media profiles or by email at info@simufy.com. If no such contact is made within the stipulated timeframe, the first alternate winner will be declared the winner.
The drawing and the awarding of the prize are subject to current tax regulations.
5.- LIMITATIONS
If it is found that any of the participants do not meet the requirements set forth in the rules, or the information provided to participate is invalid, their participation will be considered void and they will be automatically excluded from the promotion, losing all rights to the prizes awarded under this promotion.
The following persons may not participate in the Promotion:
(i) Employees employed by any of the companies and other entities with legal personality linked to SIMUFY. (ii) Natural persons who directly or indirectly participate in the capital of SIMUFY. (iii) Any other natural person who has directly or indirectly participated in the organization of this competition or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).
The prize awarded is non-transferable and cannot be changed, altered, or compensated at the request of the participants, and cannot be exchanged for any other product or cash.
SIMUFY reserves the right, if there is just cause and after prior legal notification, to make any changes, suspend or extend this Promotion.
Any tax or fiscal charges that may arise from accepting the prize, as well as any other expenses arising from the promotion that are not expressly assumed by SIMUFY in these Legal Bases, will be borne by the winner.
A period of SEVEN (7) calendar days is established from the date of the award of the prize, to make any justified claim. SIMUFY reserves, in case of necessary need, the right to replace the prize with another of similar characteristics or monetary value.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions will not be permitted on any of the brand's social media posts related to the sweepstakes if their content is considered inappropriate, offensive, slanderous, or discriminatory, or if it could violate the rights of third parties. Comments against individuals that violate the principles of the right to honor, personal and family privacy, and one's own image will also not be permitted. The brand, SIMUFY, will not be liable for any damages caused by comments made by participants in the promotion that could offend the sensibilities of other participants at any time.
Any attempt to disrupt the smooth running of the draw will result in the immediate disqualification of the participant and the cancellation of their application.
7.- EXEMPTION FROM LIABILITY
By way of example, but not limited to, SIMUFY is not responsible for any losses, thefts, delays, or any other circumstances attributable to third parties that may affect the progress of this promotion, nor for the participant's use of the prize obtained from this promotion. SIMUFY will not assume any liability for any damages or losses of any kind that may be suffered by participants, winners, or third parties.
SIMUFY will not assume liability in cases of force majeure or unforeseen circumstances that may prevent the promotion or the full or partial enjoyment of the prize. Should this promotion not be held, whether due to fraud detected during the promotion, technical errors, or any other reason beyond SIMUFY's control that affects the normal conduct of the contest, SIMUFY reserves the right to cancel, modify, or suspend the promotion.

The promotion is in no way sponsored, endorsed, administered, or associated with Twitter, Facebook, Instagram, or any other social media platforms or networks where SIMUFY or its partners and collaborators share the promotion. Participants therefore release these social media platforms from any liability for any damages arising from this promotion.

In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Legal Bases, consents to the personal data provided for participation in this contest being incorporated into a file owned by SIMUFY to process participation in the contest and to inform you of the prize if you are a winner.
Participants guarantee that the personal data provided is accurate and are responsible for notifying SIMUFY of any changes to this information. SIMUFY reserves the right to exclude from this promotion any participant found to have provided false information. The Supervisory Authority to which the complaint has been submitted shall inform the complainant about the progress and outcome of the complaint.
10.- APPLICABLE LEGISLATION AND JURISDICTION
These legal bases will be governed by Spanish law. The Courts and Tribunals of the city of Igualada will have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation, or enforcement of these bases.

The mechanics of the promotion consist of:

- Like the post and mention at least one person in the comments.
- The winner will be randomly selected using the Easypromos tool from all comments submitted by 11:59 PM on November 28th.
- The winner's name will be published on the brand's Instagram profile via the feed and stories.

One winner and three alternates will be randomly selected from the drawing.
The winners and alternates will be randomly selected through Easypromos. The certificate of validity will be publicly displayed on the Easypromos portal and may be requested by any user participating in the promotion. This certificate and the result of the promotion are unalterable.
