2. Acceptance and scope of application
Merely browsing the Website confers on the visitor the status of User (hereinafter, the "User") and implies knowledge and acceptance of the informational conditions contained in this Legal Notice.
The Website may be used both by end consumers —natural persons acting outside their business or professional activity, in accordance with art. 3 of Royal Legislative Decree 1/2007 approving the Consolidated Text of the General Law for the Defence of Consumers and Users (TRLGDCU)— and by companies, self-employed professionals and other legal persons acting in the course of their business (hereinafter, "Business Users"). The contracting conditions applicable to each profile are set out in the Terms of Service.
The contracting of products or services through the Website is additionally governed by the Terms of Service, the Shipping and Delivery Policy, the Returns and Refunds Policy and the Privacy Policy, documents that require express acceptance during the contracting process.
The User undertakes to make lawful and diligent use of the content and functionalities made available on the Website, in accordance with accepted standards of good conduct. Use of the Website and the contracting of products or services require the User to be of legal age or, failing that, to act with the due authorisation of their legal representatives.
3. Intellectual and industrial property
3.1 Ownership of proprietary content
The graphic design of the Website, its source code, original texts, proprietary photographs and other original elements are the exclusive property of SAPRO TRADING, S.L., or are used by it under licence from their respective owners.
3.2 Third-party trade marks and logos
The trade names, trade marks, logos, images and technical descriptions of products from third-party manufacturers —including, among others, Fanatec, Simucube, Simagic, Moza Racing, Trak Racer, Sim-Lab, Heusinkveld, Asetek SimSports, Playseat, Next Level Racing, Sparco, OMP, Sabelt and the other brands distributed through the Website— are the property of their respective owners. They are used on the Website within the framework of the distribution agreements in force and for strictly descriptive purposes, in accordance with art. 37 of the Spanish Trade Marks Act 17/2001.
3.3 Prohibition of unauthorised use
The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the contents of the Website is prohibited without the express written authorisation of SAPRO TRADING, S.L. or of the holder of the corresponding rights.
3.4 Notification of infringements
If you detect any content that may infringe intellectual or industrial property rights, you may report it to info@simufy.com. SAPRO TRADING, S.L. will act with the required diligence in accordance with art. 17 of the LSSI-CE.
4. Third-party links
The Website may contain links to third-party pages. SAPRO TRADING, S.L. has no control over the content of such pages or their privacy policies and therefore accepts no liability for their content or accuracy, without prejudice to the provisions of arts. 17 and 18 of the LSSI-CE.
Should any User become aware that a link leads to content that is unlawful, harmful, denigrating, violent or contrary to morality, they may report it to info@simufy.com. SAPRO TRADING, S.L. will remove the link without delay once it has actual knowledge of such nature.
5. Economic operator in the European Union
For the purposes of Regulation (EU) 2019/1020 on market surveillance and compliance of products, SAPRO TRADING, S.L. acts, in respect of products imported from manufacturers based outside the European Union (in particular, electronic equipment and simulation peripherals), as the responsible economic operator established in the Union. The identification details of the economic operator appear on the product label or in the accompanying commercial documentation.
6. Personal data protection and cookies
The processing of personal data provided by the User through the Website is governed by the Privacy Policy.
The use of cookies and similar technologies on the Website is governed by the Cookie Policy.
7. Out-of-court dispute resolution
In accordance with Regulation (EU) 524/2013 on online dispute resolution for consumer disputes —applicable exclusively to Users who qualify as consumers under the TRLGDCU—, Users are informed of the existence of the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
The Consumer User may also contact the competent consumer authorities of their place of residence or the Catalan Consumer Agency to submit complaints.
As at the date of this version, SAPRO TRADING, S.L. does not adhere to any consumer arbitration system.
8. Suspension and updating of the Website
SAPRO TRADING, S.L. may temporarily suspend access to the Website, without prior notice where reasonably necessary, for maintenance, repair, updating or improvement operations, without this giving rise to any right to compensation for the User, except for contractual liability assumed in respect of services actually contracted.
9. Amendments to the Legal Notice
SAPRO TRADING, S.L. reserves the right to amend this Legal Notice by publishing the updated version on the Website. Amendments will take effect from their publication and will apply to subsequent access, without affecting the rights acquired by Users in relation to contracts already concluded under previous versions.
10. Severability clause
If any provision of this Legal Notice is declared null and void or unenforceable by a competent authority, such declaration shall not affect the validity and effectiveness of the remaining provisions, which shall remain in full force and effect.
11. Governing law and jurisdiction
This Legal Notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the Website that is not subject to the Terms of Service, the following shall have jurisdiction:
- Consumer Users resident in Spain: the Courts and Tribunals of the consumer's place of residence.
- Consumer Users resident in other EU Member States: the courts having jurisdiction under Regulation (EU) 1215/2012 of the European Parliament and of the Council of 12 December 2012.
- Business Users (non-consumers): the parties expressly submit, waiving any other jurisdiction, to the Courts and Tribunals of the city of Barcelona.
