2. Acceptance and Scope
Merely browsing the Website grants the visitor the status of User (hereinafter, the "User") and implies knowledge and acceptance of the informational conditions set out in this Legal Notice.
The Website may be used by both end consumers — natural persons acting outside their professional or business activity — and by companies, self-employed professionals and other legal entities acting in the course of their business activity (hereinafter, "Professional Users"). The contractual conditions applicable to each profile are determined in the Terms and Conditions.
The purchase of products or services through the Website is additionally governed by the Terms and Conditions, the Shipping and Delivery Policy, the Warranty and Returns Policy, and the Privacy Policy, all of which require the User's express acceptance during the checkout process.
The User undertakes to make lawful, diligent and proper use of the content and features made available through the Website. Use of the Website and the purchase of products or services require the User to be of legal age or, failing that, to act with the appropriate authorisation of their legal representatives.
3. Intellectual and Industrial Property
3.1 Ownership of original content
The graphic design of the Website, its source code, original texts, proprietary photographs and all other original elements are the exclusive property of SAPRO TRADING, S.L., or have been used by it under licence from their respective rights holders.
3.2 Third-party brands and logos
The trade names, trademarks, logos, images and technical descriptions of products belonging to third-party manufacturers — including, among others, Fanatec, Simucube, Simagic, Moza Racing, Trak Racer, Sim-Lab, Heusinkveld, Asetek SimSports, Playseat, Next Level Racing, Sparco, OMP, Sabelt and all other brands distributed through the Website — are the property of their respective owners. Their use on the Website is carried out under the applicable commercial distribution agreements and is strictly descriptive in nature, in accordance with Article 37 of Spanish Trade Mark Law 17/2001.
3.3 Prohibition of unauthorised use
The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the Website's content is strictly prohibited without the express written authorisation of SAPRO TRADING, S.L. or the relevant rights holder.

If you become aware of any content that may constitute an infringement of intellectual or industrial property rights, please contact info@simufy.com. SAPRO TRADING, S.L. will act with due diligence in accordance with Article 17 of the LSSI-CE.

The Website may contain links to third-party websites. SAPRO TRADING, S.L. does not control the content of such websites or their privacy policies, and therefore assumes no responsibility for their content or accuracy, without prejudice to the provisions of Articles 17 and 18 of the LSSI-CE.
If any User becomes aware that a link leads to unlawful, harmful, defamatory, violent or morally objectionable content, they may notify us at info@simufy.com. SAPRO TRADING, S.L. will remove the link without delay upon becoming effectively aware of its unlawful nature.
5. Economic Operator in the European Union
For the purposes of EU Regulation 2019/1020 on market surveillance and compliance of products, SAPRO TRADING, S.L. acts, with respect to products imported from manufacturers based outside the European Union (in particular, electronic equipment and simulation peripherals), as the responsible economic operator established in the Union. The identifying details of the economic operator appear on the product label or in the accompanying commercial documentation.
6. Personal Data Protection and Cookies
The processing of personal data provided by the User through the Website is governed by the Privacy Policy.
The use of cookies and equivalent technologies on the Website is governed by the Cookie Policy.
7. Out-of-Court Dispute Resolution
In accordance with EU Regulation 524/2013 on online dispute resolution for consumer disputes — applicable exclusively to Users who qualify as consumers — the User is informed of the existence of the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Consumer Users may also contact the competent consumer authorities in their place of residence or the Catalan Consumer Agency to file complaints.
SAPRO TRADING, S.L. is not, as of the date of this version, a member of any consumer arbitration scheme.
8. Website Suspension and Updates
SAPRO TRADING, S.L. may temporarily suspend, without prior notice where reasonably necessary, access to the Website for maintenance, repair, updating or improvement purposes. Such suspension shall not give rise to any right to compensation on the part of the User, except for contractual liability assumed in respect of services effectively contracted.
9. Amendments to this Legal Notice
SAPRO TRADING, S.L. reserves the right to amend this Legal Notice by publishing the updated version on the Website. Amendments shall take effect from the date of publication and shall apply to subsequent access, without affecting rights already acquired by Users in connection with contracts concluded under previous versions.
10. Severability Clause
If any provision of this Legal Notice is declared null or unenforceable by a competent authority, such declaration shall not affect the validity and enforceability of the remaining provisions, which shall remain in full force and effect.
11. Applicable Law and Jurisdiction
This Legal Notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the Website that is not subject to the Terms and Conditions, the following courts shall have jurisdiction:
- Consumer Users resident in Spain: the courts of the consumer's place of domicile.
- Consumer Users resident in other EU Member States: the courts with jurisdiction under EU Regulation 1215/2012 of the European Parliament and of the Council of 12 December 2012.
- Professional Users (non-consumers): the parties expressly submit, waiving any other jurisdiction, to the courts of Barcelona, Spain.
