LEGAL BASES FOR PARTICIPATION IN THE “GAMERGY GIVEAWAY” PROMOTION

1.- COMPANY ORGANIZING THE PROMOTION

The company SAPRO TRADING, SL (hereinafter SIMUFY) with registered office at Ctra. BV-2131 km. 7.2, 08787 Orpí, Barcelona (Spain) and identification number B67553040, is organizing for promotional purposes the raffle, to be held through the website www.simufy.com, exclusively for users of legal age in accordance with the provisions set forth in the section on conditions for participation.

2.-START DATE AND END DATE

The promotion will start on 12/12/2023 and end on 14/12/2023 at 11:59 PM.

3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

It is important to emphasize that participation in the promotion implies unconditional acceptance and compliance with the provisions of these Legal Bases.

The participation requirements will be as follows:

- Those over 18 years of age residing in Spain are eligible to participate.
- Only real, individual participants are eligible to participate. Participation by a company or brand profile will never be considered valid.

The promotion is divided into 3 draws, the mechanics of which are as follows:

• Draw on X.
• The user must be a follower of Simufy (https://twitter.com/simufy).
• Retweet the published giveaway post.

• TikTok Giveaway.
• The user must be a follower of the Simufy profile on TikTok ( tiktok.com/@simufy_ ).
• You must like the giveaway's TikTok and mention at least one user.

• Instagram Giveaway.
• The user must be a follower of the Simufy profile on TikTok ( instagram.com/simu.fy ).
• You must mention at least one person in the comments of the giveaway post.
• Like and share.

4.- CONDITIONS OF THE PROMOTION AND PRIZES

Three winners and six alternates will be drawn from the drawing on December 15, 2023, as follows:

• X: 1 winner.
• TikTok: 1 winner.
• Instagram: 1 winner.

The winners and alternates will be randomly selected through Easypromos. The certificate of validity will be publicly displayed on the Easypromos portal and may be requested by any user participating in the promotion. This certificate and the result of the promotion are unalterable.

The winners will receive a 3-day pass to Gamergy by Cecotec 2023, valued at €43.

Winners must contact SIMUFY within 48 hours of the winner's name being announced on the brand's official social media profiles. If no such contact is made within the stipulated timeframe, the first alternate winner will be declared the winner.

Regarding the delivery of the prize, the following assumptions are established:

• The winner must be a resident of Spain, including the Canary Islands and the Balearic Islands.
• The ticket is nominative. That is, the winner must provide their real personal information to be eligible for the prize.
• The winner must provide an active email address to which they have access so that the Dreamhack Valencia 2023 organizers can ship the prize.
• Only one prize per winner may be won.

5.- LIMITATIONS

If it is found that any of the participants do not meet the requirements set forth in the rules, or the information provided to participate is invalid, their participation will be considered void and they will be automatically excluded from the promotion, losing all rights to the prizes awarded under this promotion.

The following persons may not participate in the Promotion:

(i) Employees employed by any of the companies and other entities with legal personality linked to SIMUFY. (ii) Natural persons who directly or indirectly participate in the capital of SIMUFY. (iii) Any other natural person who has directly or indirectly participated in the organization of this competition or has been directly or indirectly involved in its preparation or development (marketing agency, suppliers, etc.).

The prize awarded is non-transferable and cannot be changed, altered, or compensated at the request of the participants, and cannot be exchanged for any other product or cash.

SIMUFY reserves the right, if there is just cause and after prior legal notification, to make any changes, suspend or extend this promotion.

Any tax or fiscal charges that may arise from accepting the prize, as well as any other expenses arising from the promotion that are not expressly assumed by SIMUFY in these Legal Bases, will be borne by the winner.

A period of SEVEN (7) calendar days is established from the date of the award of the prize, to make any justified claim. SIMUFY reserves, in case of necessary need, the right to replace the prize with another of similar characteristics.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions will not be permitted on any of the brand's social media posts related to the sweepstakes that contain inappropriate, offensive, defamatory, discriminatory content, or content that could violate the rights of third parties.

Comments against individuals that violate the principles of the right to honor, personal and family privacy, and one's own image will also not be permitted. The SIMUFY brand will not be liable for any damages caused by comments made by participants in the promotion, which at any time could offend the sensibilities of other participants.

Any attempt to disrupt the smooth running of the draw will result in the immediate disqualification of the participant and the cancellation of their application.

7.- EXEMPTION FROM LIABILITY

By way of example, but not limited to, SIMUFY is not responsible for any losses, thefts, delays, or any other circumstances attributable to third parties that may affect the progress of this promotion, nor for the participant's use of the prize obtained from this promotion. SIMUFY will not assume any liability for any damages or losses of any kind that may be suffered by participants, winners, or third parties.

SIMUFY will not assume liability in cases of force majeure or unforeseen circumstances that may prevent the promotion or the full or partial enjoyment of the prize. Should this promotion not be held, whether due to fraud detected during the promotion, technical errors, or any other reason beyond SIMUFY's control that affects the normal conduct of the contest, SIMUFY reserves the right to cancel, modify, or suspend the promotion.

8.- INSTAGRAM, TIKTOK AND X.

The promotion is in no way sponsored, endorsed, administered, or associated with Instagram, TikTok, Discord, or any other social media platforms or networks where SIMUFY or its partners and collaborators share the promotion. Participants therefore release these social media platforms from any liability for any damages arising from this promotion.

9.- PROTECTION OF PERSONAL DATA

SIMUFY takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept secure and treated with the utmost care.

In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Legal Bases, consents to the personal data provided for participation in this contest being incorporated into a file owned by SIMUFY to process participation in the contest and to inform you of the prize if you are a winner.

We inform you that your personal contact information will be used for the following purposes:

Participants guarantee that the personal data provided is accurate and are responsible for notifying SIMUFY of any changes to the data. SIMUFY reserves the right to exclude from this promotion any participant found to have provided false information. It is recommended that you exercise maximum diligence in data protection matters by using security tools. SIMUFY cannot be held responsible for any unlawful theft, modification, or loss of data.

Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, particularly in the Member State in which he or she has his or her habitual residence, place of work, or place of the alleged infringement, if he or she considers that the processing of his or her personal data is not in compliance with the regulations, as well as if he or she is not satisfied with the exercise of his or her rights.

The Supervisory Authority to which the complaint has been filed will inform the complainant about the progress and outcome of the complaint.

10.- APPLICABLE LEGISLATION AND JURISDICTION

These legal terms and conditions shall be governed by Spanish law. The Courts and Tribunals of the Participant's city shall have jurisdiction to resolve any claim or dispute that may arise regarding the validity, interpretation, or enforcement of these terms and conditions.
