LEGAL BASES FOR PARTICIPATION IN THE “MCLAREN 720s SIMLINE STEERING WHEEL GIVEAWAY” PROMOTION
1.- COMPANY ORGANIZING THE PROMOTION
The company SAPRO TRADING, SL (hereinafter SIMUFY) with registered office at BV-2131 km. 7.2, 08787 Orpí, Barcelona (Spain) and identification number B67553040, is organizing for promotional purposes the raffle, to be developed through the brand's Discord channel ( https://discord.gg/simufy ), exclusively for users of this social network with the provisions set forth in the conditions for participation section.
2.-START DATE AND END DATE
The promotion will start on 10/11/2023 and end on 17/11/2023 at 12:00 p.m.
3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS
It is important to emphasize that participation in the promotion implies unconditional acceptance and compliance with the provisions of these Legal Bases.
The participation requirements will be as follows:
- Only real, individual participants are eligible to participate. Participation by a company or brand profile will never be considered valid.
The mechanics of the Promotion consist of:
- Join the Simufy Discord community ( https://discord.gg/simufy )
- Participate in the promotion through the “Sweepstakes” channel.
The draw will take place once a community of at least 150 users is reached.
If this number is not reached by the estimated date, the start date of the draw will be postponed until it is reached.
4.- CONDITIONS OF THE PROMOTION AND PRIZES
The winner and two alternates will be selected on November 17, 2023. The winner's name will be published on the same "Sweepstakes" channel.
The winner will be randomly selected using the Easypromos tool. The certificate of validity will be publicly displayed on Discord and can be requested by any user participating in the promotion. This certificate and the result of the promotion are unalterable.
The winner will receive as a prize:
- a McLaren 720s SIMLINE steering wheel valued at €649.99
The winner must contact SIMUFY within 48 hours of the date the winner's name is announced on the brand's official social media profiles. If no such contact is made within the stipulated period, the first alternate winner will be declared the winner.
Regarding the shipping of the prize and the shipping costs applied to said shipping of the prize, the following assumptions are established:
- If the winner is a resident of Spain (Mainland or the Balearic Islands), SIMUFY will bear the full shipping costs of the prize, and the winner will not have to pay anything.
- If the winner is NOT a resident of Spain (mainland) or the Balearic Islands, but is based in the Canary Islands or another country, the winner will be responsible for paying the prize's shipping costs. If the winner refuses to make payment, the prize will automatically be forfeited, and the prize will go to the first alternate.
The drawing and the awarding of the prize are subject to current tax regulations.
5.- LIMITATIONS
If it is found that any of the participants do not meet the requirements set forth in the rules, or the information provided to participate is invalid, their participation will be considered void and they will be automatically excluded from the promotion, losing all rights to the prizes awarded under this promotion.
The following persons may not participate in the Promotion:
(i) Employees employed by any of the companies and other entities with legal personality linked to SIMUFY. (ii) Natural persons who directly or indirectly participate in the capital of SIMUFY. (iii) Any other natural person who has directly or indirectly participated in the organization of this competition or has been directly or indirectly involved in its preparation or development (marketing agency, suppliers, etc.).
The prize awarded is non-transferable and cannot be changed, altered, or compensated at the request of the participants, and cannot be exchanged for any other product or cash.
SIMUFY reserves the right, if there is just cause and after prior legal notification, to make any changes, suspend or extend this promotion.
Any tax or fiscal charges that may arise from accepting the prize, as well as any other expenses arising from the promotion that are not expressly assumed by SIMUFY in these Legal Bases, will be borne by the winner.
A period of SEVEN (7) calendar days is established from the date of the award of the prize, to make any justified claim. SIMUFY reserves, in case of necessary need, the right to replace the prize with another of similar characteristics.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions will not be permitted on any of the brand's social media posts or Discord posts related to the giveaway that contain content deemed inappropriate, offensive, slanderous, or discriminatory content, or that could violate the rights of third parties. Comments against individuals that violate the principles of the right to honor, personal and family privacy, and one's own image will also not be permitted. The brand, SIMUFY, will not be liable for any damages caused by comments made by participants in the promotion that may at any time offend the sensibilities of other participants.
Any attempt to disrupt the smooth running of the draw will result in the immediate disqualification of the participant and the cancellation of their application.
7.- EXEMPTION FROM LIABILITY
By way of example, but not limited to, SIMUFY is not responsible for any losses, thefts, delays, or any other circumstances attributable to third parties that may affect the progress of this promotion, nor for the participant's use of the prize obtained from this promotion. SIMUFY will not assume any liability for any damages or losses of any kind that may be suffered by participants, winners, or third parties.
SIMUFY will not assume liability in cases of force majeure or unforeseen circumstances that may prevent the promotion or the full or partial enjoyment of the prize. Should this promotion not be held, whether due to fraud detected during the promotion, technical errors, or any other reason beyond SIMUFY's control that affects the normal conduct of the contest, SIMUFY reserves the right to cancel, modify, or suspend the promotion.
8.- DISCORD.
The promotion is in no way sponsored, endorsed, administered, or associated with Discord or any other platform or social media platform where SIMUFY or its partners and collaborators share the promotion. Participants therefore release these social media platforms from any liability for any damages arising from this promotion.

In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Legal Bases, consents to the personal data provided for participation in this contest being incorporated into a file owned by SIMUFY to process participation in the contest and to inform you of the prize if you are a winner.
We inform you that your personal contact information will be used for the following purposes:
Participants guarantee that the personal data provided is accurate and are responsible for notifying SIMUFY of any changes to the data. SIMUFY reserves the right to exclude from this promotion any participant found to have provided false information. It is recommended that you exercise maximum diligence in data protection matters by using security tools. SIMUFY cannot be held responsible for any unlawful theft, modification, or loss of data.

Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, particularly in the Member State in which he or she has his or her habitual residence, place of work, or place of the alleged infringement, if he or she considers that the processing of his or her personal data is not in compliance with the regulations, as well as if he or she is not satisfied with the exercise of his or her rights.
The Supervisory Authority to which the complaint has been filed will inform the complainant about the progress and outcome of the complaint.
10.- APPLICABLE LEGISLATION AND JURISDICTION
These legal bases will be governed by Spanish law. The Courts and Tribunals of Barcelona will have jurisdiction to resolve any claim or dispute that may arise regarding the validity, interpretation, or enforcement of these bases.
