LEGAL BASES FOR PARTICIPATION IN THE PROMOTION “Base Direct Drive R9 V2 MOZA and the RS V2 MOZA Steering Wheel” ON INSTAGRAM WITH THE COLLABORATION OF ANN SUKI

1.- COMPANY ORGANIZING THE PROMOTION

The company SAPRO TRADING, SL (hereinafter SIMUFY) with registered office at Ctra. BV-2131 km 7.2, 08787 Orpí, Barcelona (Spain) and identification number B67553040, organizes for promotional purposes the national raffle, to be developed through social networks, exclusively for users of legal age in accordance with the provisions set forth in the section on conditions for participation.

2.-START DATE AND END DATE

The promotion will start on April 8, 2023, and end on April 14, 2024, at 11:59 p.m.

3.- PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

It is important to emphasize that participation in the promotion implies unconditional acceptance and compliance with the provisions of these Legal Bases.

The participation requirements will be as follows:

  • Those over 18 years of age may participate.
  • Only real, individual participants are eligible to participate. Participation by a company or brand profile will never be considered valid.

4.- CONDITIONS OF THE PROMOTION AND PRIZES

One winner and three alternates will be randomly selected from the drawing.

The winners and alternates will be randomly selected through Easypromos. The certificate of validity will be publicly displayed on the Easypromos portal and may be requested by any user participating in the promotion. This certificate and the result of the promotion are unalterable.

The winner will receive a Direct Drive R9 V2 MOZA Base and the RS V2 MOZA Steering Wheel valued at €979.98.

The winner must contact SIMUFY (and not ANN SUKI or HECTOR EG) within 48 hours of their name being announced on the brand's Instagram profile, either via direct message on social media or by email at info@simufy.com. If no such contact is made within the stipulated period, the first alternate winner will be declared the winner, and so on until the prize is awarded.

Regarding the shipping of the prize and the shipping costs applied to said shipping of the prize, the following assumptions are established:

  • The winner must be a resident of Spain (mainland and the Balearic Islands, excluding the Canary Islands). SIMUFY will cover the entire shipping cost of the prize, and the winner will not be responsible for any costs.

The drawing and the awarding of the prize are subject to current tax regulations.

5.- LIMITATIONS

If it is found that any of the participants do not meet the requirements set forth in the rules, or the information provided to participate is invalid, their participation will be considered void and they will be automatically excluded from the promotion, losing all rights to the prizes awarded under this promotion.

The following persons may not participate in the Promotion:

  1. Employees employed in any of the companies and other entities with legal personality linked to SIMUFY, ANN SUKI or HECTOR EG.
  2. Natural persons who participate directly or indirectly in the capital of SIMUFY, ANN SUKI or HECTOR EG.
  3. Any other natural person who has participated directly or indirectly in the organization of this competition or has been directly or indirectly involved in its preparation or development (marketing agency, suppliers, etc.).
  4. Multiple participations with fake accounts or accounts created for such event/action.

The prize awarded is non-transferable and cannot be changed, altered, or compensated at the request of the participants, and cannot be exchanged for any other product or cash.

SIMUFY, ANN SUKI, and HECTOR EG reserve the right, if there is just cause and after prior legal notification, to make any changes, suspend, or extend this promotion.

Any tax or fiscal charges that may arise from accepting the prize, as well as any other expenses arising from the promotion that are not expressly assumed by SIMUFY in these Legal Bases, will be borne by the winner.

A period of SEVEN (7) calendar days is established from the date of the award of the prize, to make any justified claim. SIMUFY, ANN SUKI and HECTOR EG reserve, in case of necessary need, the right to replace the prize with another of similar characteristics.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions will not be permitted on any of the brand's social media posts related to the sweepstakes if their content is considered inappropriate, offensive, slanderous, or discriminatory, or if it could violate the rights of third parties. Comments against individuals that violate the principles of the right to honor, personal and family privacy, and one's own image will not be permitted. The brands SIMUFY, ANN SUK, and HECTOR EG will not be liable for any damages caused by comments made by participants in the promotion that could offend the sensibilities of other participants at any time.

Any attempt to disrupt the smooth running of the draw will result in the immediate disqualification of the participant and the cancellation of their application.

7.- EXEMPTION FROM LIABILITY

By way of example, but not limited to, SIMUFY, ANN SUKI, and HECTOR EG are not responsible for any losses, thefts, delays, or any other circumstances attributable to third parties that may affect the progress of this promotion, nor for the participant's use of the prize obtained from this promotion. SIMUFY will not assume any liability for any damages or losses of any kind that may be suffered by participants, winners, or third parties.

SIMUFY, ANN SUKI and HECTOR EG will not assume responsibility in cases of force majeure or fortuitous events that could prevent the promotion or the full or partial enjoyment of the prize. In the event that this promotion cannot be carried out, whether due to fraud detected during the promotion, technical errors, or any other reason beyond the control of SIMUFY, ANN SUKI and HECTOR EG that affects the normal development of the contest, SIMUFY, ANN SUKI and HECTOR EG reserve the right to cancel, modify, or suspend it.

8.- INSTAGRAM.

The promotion is in no way sponsored, endorsed, administered, or associated with Instagram or any other platform or social media platform where SIMUFY, ANN SUKI, and HECTOR EG or their partners and collaborators share the promotion. Participants therefore release this social media platform from any liability for any damages arising from this promotion.

SIMUFY, ANN SUKI, and HECTOR EG take the protection of your privacy and personal data very seriously. Therefore, your personal information is kept secure and treated with the utmost care.

In accordance with the provisions of the applicable regulations on data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, by accepting these Legal Bases, consents to the personal data provided for participation in this contest being incorporated into a file owned by SIMUFY, ANN SUKI and HECTOR EGI to process participation in the contest and to inform you of the prize if you are a winner.

Participants guarantee that the personal data provided is accurate and are responsible for informing SIMUFY, ANN SUKI, and HECTOR EG of any changes to their personal data. SIMUFY, ANN SUKI, and HECTOR EG reserve the right to exclude from this promotion any participant found to have provided false data. It is recommended that you exercise maximum diligence in data protection matters by using security tools. SIMUFY, ANN SUKI, and HECTOR EG cannot be held responsible for any unlawful theft, modification, or loss of data.

Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, particularly in the Member State in which he or she has his or her habitual residence, place of work, or place of the alleged infringement, if he or she considers that the processing of his or her personal data is not in compliance with the regulations, as well as if he or she is not satisfied with the exercise of his or her rights.

The Supervisory Authority to which the complaint has been filed will inform the complainant about the progress and outcome of the complaint.

10.- APPLICABLE LEGISLATION AND JURISDICTION

These legal bases will be governed by Spanish law. The Courts and Tribunals of the city of Igualada will have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation, or enforcement of these bases.
