1. Returns, exchanges and exercise of the right of withdrawal
Users will have a period of fourteen (14) calendar days to make changes or returns from receipt of the product, in accordance with the provisions of Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.
In order to comply with the Withdrawal Period, it is necessary that we are informed of the exercise of this right before the expiry of this period. Once this period has expired, no declarations of withdrawal of product purchases will be accepted.
The Products must be sent duly packaged immediately after or, in any case, within fourteen (14) days from the date on which you informed us of your withdrawal from the contract. The deadline shall be deemed to have been met when the Products are dispatched before the expiry of the aforementioned period.
Para ejercitar su derecho de desistimiento deberá comunicárnoslo a (SIMUFY, Ctra. BV-2131 km. 7,2, 08787 Orpí, Barcelona, España) enviando una declaración clara (como una carta por
correo postal, o un fax o correo electrónico) manifestando su decisión de desistir del contrato. Puede utilizar el modelo de desistimiento que se adjunta como Anexo 1 a los presentes Términos y Condiciones, si bien su uso no es obligatorio. También puede desistir del contrato de compraventa de forma electrónica, cumplimentando una declaración de desistimiento explícita a través del siguiente formulario. Si utilizara esta opción, le confirmaremos la recepción del desistimiento del pedido por correo electrónico.
Adicionalmente, el Usuario deberá encargarse de gestionar el envío de la mercancía a la siguiente dirección (SIMUFY, Ctra. BV-2131 km. 7,2, 08787 Orpí, Barcelona, España), debiendo el Usuario pagar los costes del envío de devolución de conformidad con lo dispuesto en el artículo 108.1 del Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.
The following are excluded from the right of withdrawal:
- The supply of goods or services made to the customer's specifications or clearly personalized.
- El suministro de bienes que no sean aptos para ser devueltos por razones de protección de la salud o de higiene y que hayan sido desprecintados tras la entrega. Por ejemplo, ropa interior, calcetines.
- The supply of goods which, after delivery, are susceptible to damage and, taking into account their nature, have been inseparably mixed with other goods, such as fiber, aluminum and/or steel products (such as Racing Seats, cockpits, trays, platforms, monitor supports, Accessories for cockpits, etc.);
- The supply of goods acquired through public auction.
- Goods that are not in their original packaging;
- Goods that have been used or installed with abusive wear and tear and/or have signs of use different from that inherent to their testing.
- Products that were purchased in a Refurbished condition.
Los daños causados en los
productos como consecuencia de un uso diferente a aquel inherente a la prueba del producto comercializado serán responsabilidad del Usuario de conformidad con el artículo 108.2 del Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y usuarios y otras leyes complementarias. Por lo tanto, Simufy se reserva el derecho de cuantificar los daños sufridos por estas circunstancias y minorar o denegar el reembolso del Usuario en esta cantidad.
If the User, when purchasing the good, expressly selected a specific delivery method that was more expensive than the ordinary delivery method, SIMUFY is not obliged to reimburse the additional costs incurred by using this specific delivery method.
Consumers are hereby informed that Simufy does not perform product exchanges or exchanges. As such, the quickest way to ensure you get what you want is to return the item you have and, once the return is accepted, make a separate purchase of the new item.
En caso de cancelar un pedido antes de su envío, se emitirá un vale regalo por el importe abonado, aplicando una deducción del 3% en concepto de comisión de la pasarela de pago y gastos administrativos. Este vale podrá utilizarse en futuras compras en nuestra tienda y tendrá una validez de 12 meses. Puede proceder a la cancelación de su pedido de forma electrónica a través del siguiente formulario.
2. Consequences of withdrawal
In case of withdrawal, we will refund the payment received by the User for the Sale and Purchase of the Product subject to withdrawal without undue delay from the date on which SIMUFY has been able to verify that the Product meets the requirements to be subject to the right of withdrawal, and within a maximum period of 14 days. Thus, until Simufy has received the product subject to withdrawal, the amount paid will not be refunded.
Partial returns of an order will result in the reimbursement of the proportional part of the price paid by the User for that order.
3. Returns due to manufacturing defects and warranty
SIMUFY undertakes to repair or replace the Products that present defects in accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. For the purposes of these Terms and Conditions, defect of conformity is understood as the lack of compliance with the specifications provided by the product at the time of purchase by the User and / or the lack of suitability of the good for the purpose for which it was designed. Normal wear and tear due to the use of the product is not considered as a defect of conformity (e.g.: wear and tear on rings made of alcantara material).
No reimbursement and/or repair under warranty will be made for Products that:
- were obtained from a source other than the Platform;
- have been injured as a result of negligence or willful misconduct (such as exposure to chemicals, caustic substances, open fire, high temperatures, sharp objects, etc.); and/or
- have been damaged by careless use;
- damage due to normal wear and tear or that have exceeded their economic useful life.
En cualquier caso, SIMUFY se
responsabiliza de la recogida de los Productos en la dirección indicada por el Usuario y de los gastos que el transporte hasta el almacén lleve aparejados.
For orders placed prior to January 1, 2022, the aforementioned term shall be TWO (2) YEARS.
The aforementioned periods may be increased in the event that the manufacturer of the product offers a longer warranty.
In any case, the Customer must contact SIMUFY or request the collection of the Product within a maximum period of TWO (2) months from the discovery of the defect, and must inform of the nature of the problem, the time and conditions of its occurrence.
If the conformity by repair or replacement is not possible, SIMUFY will inform the User of this circumstance and will proceed to reimburse the price paid.
It shall be presumed that the cause of the lack of conformity already existed at the time of delivery during the TWO (2) years following delivery. After these two (2) years, it shall be up to the User to prove that this lack of conformity is due to a cause attributable to SIMUFY or its manufacturers and/or suppliers.
After TWO (2) years from the date of invoice, the equipment for repair shall be sent carriage paid by the User.
SIMUFY may undertake to repair or arrange for the repair of products that are not covered by the warranty in accordance with this provision, provided that the User is responsible for the payment of the costs, including shipping costs.
SIMUFY reserves the right to verify if the defect has been caused by a manufacturing fault or a use contrary to the instructions of use of the Product by the User. Likewise, SIMUFY reserves the right to request an official technical service of the brand to verify the origin of the problem.
Repairs and replacements will be carried out within a reasonable period of time after collection and evaluation of the Product. However, depending on the availability of substitute products, as well as the costs and time required to carry out repairs, the time periods may vary.
